Once the online purchase procedure is completed, the Customer is required to print and keep these general conditions of sale and the related order form, already viewed and accepted.

These General Conditions of Sale relate to the sale of products made online through the e-commerce service on the website www.erredibisandali.it In consideration of the large number of products available, the main characteristics and the prices of the same (including any additional costs) are clearly indicated directly on the site.

2.2 These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on www.erredibisandali.it and do not, however, govern the supply of services or the sale of products by different subjects that are present on www.erredibisandali.it through links, banners or other hypertext links. Before submitting orders and purchasing products and services from subjects other than Erredibi, we suggest checking their conditions of sale, because Erredibi is not responsible for the supply of services by third parties other than different ones.
2.3 The products are sold to the Customer identified by the data entered when completing and sending the order form in electronic format with simultaneous acceptance of these General Conditions of Sale.
2.4 The product offers on the www.erredibisandali.it site are aimed at adult customers. By placing an order through the website, you guarantee that you are of age (18 years old) and have the legal capacity to enter into binding contracts.
2.5 The Customer is forbidden to enter false, and / or invented, and / or invented names in the online ordering procedure and in further communications. Erredibi reserves the right to legally prosecute any violation and abuse, in the interest and for the protection of all consumers.
2.6 By accepting these Conditions of Sale, moreover, Erredibi is exonerated from any liability deriving from the issuance of incorrect tax documents due to errors relating to the data provided when placing the online order, being the customer solely responsible for the their correct insertion.

3. The sale through e-commerce service
3.1 By online sales contract is meant the remote contract concerning the sale of movable goods (hereinafter Products) entered into between the Customer and ERREDIBI, as part of an electronic commerce service organized with the help of the internet.
3.2 To conclude the purchase contract for one or more Products, it is necessary to fill out the order form in electronic format (hereafter Order) and transmit it to Erredibi through the Internet following the relative instructions.
3.3 The General Conditions of Sale are available on the xwww.erredibisandali.it website; the information and images of each Product and its price; the means of payment to be used; the methods of delivery of the Products purchased and the related shipping and delivery costs; the reference to the conditions for the right of withdrawal; the methods and times for returning the purchased products.
3.4 Although Erredibi constantly adopts measures to ensure that the photographs shown on the site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and of resolution of the colors of the computer used by the Customer. Consequently, Erredibi will not be responsible for any inadequacy of the graphic representations of products shown on the site if due to the aforementioned technical reasons, since these representations are merely illustrative.
3.5 Before concluding the contract, you will be asked to confirm the reading of the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.
3.6 The contract is concluded when Erredibi receives the Order Form, after verifying the correctness of the data relating to your order.
3.7 The language available to conclude the contract with Erredibi is Italian and the applicable law is Italian.
3.8 With the conclusion of the contract, Erredibi will take charge of the order for its fulfillment.

4. Order fulfillment
4.1 With the transmission of the Order Form, you accept unconditionally to observe, in relations with Erredibi, these General Conditions of Sale.
4.2 Once the contract is concluded, Erredibi will send an order confirmation by e-mail, containing a summary of the information.
4.3 The possibility remains for Erredibi, before sending the order confirmation, to request further information with reference to the Order sent.
4.4 Erredibi may not process purchase orders which do not give sufficient guarantees of solvency or which are incomplete or incorrect or in the event of unavailability of the products. In these cases, the Customer will be informed that the contract is not concluded and that Erredibi has not followed up on the Order, specifying the reasons. In this case, the sum committed on the Customer’s means of payment will be released.
4.5 If the products on the website www.erredibisandali.it are no longer available or on sale after sending the Order, Erredibi will take care of communicating to the Customer promptly and in any case within thirty (30) working days to starting from the day following that in which the order will be sent to Erredibi, the possible unavailability of the Products ordered. In this case, the sum committed on the Customer’s means of payment will be released.
4.6 Erredibi undertakes to deliver the products ordered to the Customer no later than ……. (insert the days within which the delivery will take place) days from the date of conclusion of the contract.
4.7 Each sale made by Erredibi through the online sales service may concern one or more products, without limit of quantity for each item.
4.8 Erredibi reserves the right to refuse orders from a customer with whom there is an ongoing legal dispute relating to a previous order. This applies equally to all cases in which Erredibi considers the customer unsuitable, including, by way of example, the case of previous violations of contract conditions for online purchase on the site or for any other legitimate reason, especially if the Customer has been involved in fraudulent activities of any kind.

5. Selling prices
5.1 Unless otherwise indicated in writing, all Product prices and shipping and delivery costs indicated on the website and in the Order are to be considered VAT included and expressed in euros. The validity of the prices indicated is always and only that indicated by the website www.erredibisandali.it at the time of transmission of the Order through the internet. The prices of the Products and the shipping and delivery costs may vary without notice. In this case, the date of dispatch of the relevant Order will prevail.
5.2 All Products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated on the website and in the Order, unless otherwise specified, are to be considered not inclusive of any costs related to customs duties and related taxes, which cannot be calculated in advance, if the shipment takes place in non-EU countries or in countries where the current legislation provides for import charges. In this case, the existence of any additional costs indicated above will be clearly mentioned during the insertion and revision of the Order, it being understood that the precise amount of these costs will be communicated by the carrier to the Customer at the time of delivery of the products.
5.3 These costs are therefore charged to the Customer and must be paid directly upon delivery of the Products

6. Methods of payment
To pay the price of the Products and the related shipping and delivery costs, follow one of the methods indicated in the order form of the website www.erredibi.it and which are summarized below.
6.1 Credit cards and prepaid cards.
6.1.1 For online orders we accept both credit card and prepaid card payments (for example, PostePay) without any additional charge on the cost of the product and shipping. It is understood that you must be a valid credit card holder when ordering the Products purchased online.
6.1.2 At the time of online purchase, at the same time as the confirmation of the Order, the reference banking institution will only carry out the commitment of the amount relating to the Order from the present availability of the credit card. The amount will actually be charged to the credit card only when the purchased products are shipped.
6.1.3 If, once the package has been received with the order, for any reason, the Customer will want to avail himself of the Right of withdrawal (insert the link that automatically goes to point 9), following the payment of the Products purchased online, the Erredibi will instruct the banking institution to credit the amount to be refunded directly to the credit card used during the purchase.
6.2 Paypal.
6.2.1 If you have a Paypal account, Erredibi gives you the possibility to make payments using directly your email and registration password on www.paypal.com.
6.3 Marking.
6.3.1 It is possible to pay the order directly to the courier who will deliver the products, in cash with an increase of five (5) euros, as the conventional cost imposed by the carrier.
6.4 Bank transfer.
6.4.1 It is possible to pay the order quickly and securely using your home banking by directly debiting the amount to the current account used for the purchase.
6.5 At no time during the purchase procedure Erredibi is able to know the information relating to the credit card (for example, the credit card number or the expiry date), transmitted via a connection protected by an encrypted protocol directly to the site of the subject that manages the electronic payment (bank or Paypal). No computer archive of Erredibi will keep such data.
6.6 In no event can Erredibi be held responsible for any fraudulent and undue use of credit and prepaid cards by third parties.

7. Shipping and delivery of products
7.1 Erredibi will ship the Purchased Products at no extra charge. The shipment contains: the / the products / or ordered / or; the relative transport document / accompanying invoice; any accompanying documentation required based on the country of dispatch; any information and marketing material.
7.2 The delivery of the Products purchased through the Erredibi website can take place in different ways.
7.3 Delivery to the Customer’s home
7.3.1 The purchased Products will be delivered by the courier identified by Erredibi to the shipping address indicated by the Customer on the Order.
7.3.2 Upon receipt of the goods at home, the Customer must verify the integrity of the packages at the time of delivery by the courier. In case of anomalies, the courier must detect and note exactly the same and reject the delivery. Otherwise you will lapse from the possibility to assert the rights in this regard.
7.4 Delivery to agreed sales point and collection by the customer
7.4.1 Only if this option is specifically provided for, the purchased Products can be delivered by Erredibi to an affiliated point of sale that can be selected at the time of the Order.
7.4.2 Upon delivery of the products purchased at the store, the customer will be sent an email and / or text message and from that moment you will have up to 10 working days to collect the Products ordered.
7.4.3 Failure to collect at the end of this period will result in the cancellation of the order by Erredibi and the refund of the entire sum previously paid. The refund will be made to the credit card or Paypal account according to the payment system selected during the online purchase phase.

8. Warranty of non-compliant products
8.1 Erredibi is responsible for any defect in the products offered on the site, including the non-compliance of the items with the products ordered, in accordance with the provisions of Italian law.
8.2 If the Customer has entered into the contract as a consumer (i.e. any natural person who acts on the site www.erredibisandali.it for purposes unrelated to any business or professional activity carried out), this guarantee is valid provided that both are respected the following conditions:
a) the defect occurs within twenty-four (24) months from the date of delivery of the products;
b) the Customer submits a formal complaint relating to the defects within a maximum of sixty (60) days from the date on which the defect was recognized;
8.3 In particular, in the event of non-compliance, the Customer who entered into the contract as a consumer will have the right to obtain the restoration of the conformity of the products without expenses, by repair or replacement, or to obtain an appropriate price reduction or the termination of the contract relating to the disputed goods and the consequent return of the price.
8.4 All return costs for defective products will be borne by Erredibi.

9 Diritto di recesso
9.1 Se il Cliente che stipula il contratto è un consumatore (ossia qualsiasi persona fisica che agisca sul sito www.erredibisandali.it per scopi estranei all’attività imprenditoriale o professionale eventualmente svolta), esso ha il diritto di recedere dal contratto concluso, senza alcuna penalità e senza specificarne il motivo, comunicandolo a ……………….(ragione sociale di erredibi, indirizzo, numero civico e cap) entro il termine di giorni quattordici (14), decorrenti dal giorno in cui il Cliente o un terzo (incaricato dal Cliente), acquisisce il possesso fisico dei beni. Il termine si intende rispettato se il Cliente avrà rispedito i beni prima della scadenza del periodo di 14 giorni.
9.2 Il diritto di recesso è sottoposto alle seguenti condizioni:
• I Prodotti resi vanno restituiti nella loro integrità e non su parti o componenti di essi;
• I Prodotti resi non devono essere stati utilizzati, indossati, lavati o danneggiati;
• I Prodotti resi devono essere inviati alla Erredibi in una sola spedizione. La Erredibi si riserva il diritto di non accettare Prodotti di uno stesso Ordine resi e spediti in momenti differenti;
• I Prodotti resi devono essere restituiti nella loro confezione originale;
• I Prodotti resi devono essere spediti o consegnati al corriere entro quattordici (14) giorni decorrenti dalla data di ricezione degli stessi;
9.3 Se il diritto di recesso è esercitato conformemente alle precedenti condizioni (comma 9.2), la Erredibi è tenuta a rimborsare le somme versate dal cliente entro e non oltre 14 giorni decorrenti dal momento in cui lo stesso è stato informato della decisione di esercitare il diritto di recesso, a condizione che la Erredibi abbia già ricevuto la restituzione dei beni. La Erredibi utilizzerà per il riaccredito lo stesso mezzo di pagamento dal Cliente utilizzato per la transazione iniziale.
9.4 In caso di recesso con restituzione di tutti i Prodotti acquistati le spese di spedizione saranno a carico del Cliente. Nel caso in cui, invece, il Cliente sempre nel termine di giorni quattordici (14) decide di sostituire i Prodotti originariamente acquistati e ricevuti, le spese di restituzione saranno a carico del Cliente, mentre le spese di consegna dei nuovi prodotti saranno a carico di Erredibi (ad eccezione dei costi supplementari derivanti dalla eventuale scelta di utilizzare una modalità di consegna diversa e più costosa).
9.5 La Erredibi si impegna a sostenere le spese di spedizione iniziali dei Prodotti esclusivamente in caso di danno agli stessi dovuto al trasporto o di errori nella spedizione. Solamente in questi casi la Erredibi rimborserà anche l’importo pagato a titolo di spese di spedizione.
9.6 In caso di esercizio del diritto di recesso la Erredibi provvederà al rimborso corrispondente, entro quattordici (14) giorni dalla data di ricezione da parte dello stesso dei Prodotti resi secondo le modalità sopra indicate, mediante accredito dell’importo da rimborsare con le stesse modalità di pagamento scelto al momento dell’ordine d’acquisto.
9.7 In caso di esercizio del diritto di recesso senza il rispetto delle modalità sopra indicate, Erredibi provvederà a rinviare nuovamente i Prodotti acquistati addebitando al Cliente anche le ulteriori spese di spedizione.
9.8 Il diritto di recesso è escluso e quindi non potrà essere esercitato nel caso in cui prodotti acquistati siano stati personalizzati su esplicita richiesta dal Cliente al momento dell’inserimento dell’ordine d’acquisto.

10. Communications to the customer

12. Applicable law, dispute resolution and jurisdiction
These General Conditions of Sale are governed by Italian law and will be interpreted on the basis of it, without prejudice to any other prevailing mandatory rule in the country of habitual residence of the Customer. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law and any inherent and / or consequent disputes thereof must be resolved exclusively by the Italian judicial authority. In particular, if the customer has the status of consumer, any disputes must be resolved by the court of the place of residence or residence of the same according to the applicable law or, at the choice of the consumer in case of action taken by the consumer himself, by the Court of Brindisi. If the Customer instead acts in the exercise of his entrepreneurial, commercial, artisanal or professional activity, the parties consensually establish the exclusive jurisdiction of the Court of Brindisi.

13. Modification and updating
Erredibi can make changes or amendments to these General Conditions of Sale at any time. Therefore, the Customer will be asked to accept only the General Conditions of Sale in force at the time of the relative purchase. The new General Conditions of Sale will be effective from the date of publication on the website www.erredibi.it and in relation to purchase orders submitted after that date.
